Williams v. Ysabel, Superior Court of New Jersey, Appellate Division, decided September 7, 2023: Non-precedential New Jersey decision holding that court action filed against multiple defendants, some of whom were required to arbitrate disputes, and others that were non-parties to the arbiteration agreement, would be suspended as to all parties, but not dismissed as to any, pending outcome of the arbitration proceedings.

Pharr v. Lowe's, Superior Court of New Jersey, Appellate Division, decided August 21, 2023: Non-precedential New Jersey decision holding that arbitration clauses in employment agreements are enforceable even when statutory Law Against Discrimination (“LAD”) claims are asserted.

Racioppi v. Airbnb, Superior Court of New Jersey, Appellate Division, decided July 17, 2023: Non-precedential New Jersey decision enforcing an arbitration agreement even though that agreement was buried on an internal page of the party's web site,

Corsi v. Cellco Partnership d/b/a Verizon Wireless, D.N.J., signed June 2, 2023: Non-precedential federal decision of United States District Court holding that when deciding a motion to compel arbitration, a court must ascertain whether a valid agreement to arbitrate exists, and whether the particular dispute falls within the scope of that agreement. To conduct this inquiry, the court shall apply ordinary state-law principles that govern the formation of contracts.

Bedrock Steel v. Raritan Urban Renewal, Superior Court of New Jersey, Appellate Division, decided May 8, 2023: Agreement in electronic record to arbitrate a dispute is valid; to be enforceable, agreement to arbitrate must specify that arbitration is to be the exclusive means of resolving the dispute.

Santana v. Smiledirectclub, LLC, Superior Court of New Jersey, Appellate Division, decided April 3, 2023: Arbitration agreement reachable only by clicking on hypertexted “Terms and Conditions” page, constitutes enforceable legal notice, regardless of whether the party against whom arbitration is sought actually read the agreement.
